Our solicitors are in Court every day defending clients. The sheriff court is where the less serious offences are dealt with. The Sheriff Court in summary procedures (where a judge or magistrate hears the case) can sentence an accused for a maximum of twelve months, and impose a fine of up to £10,000. In solemn procedure, (where a judge sits with a jury), the Sheriff Court has a sentencing power of up to five years and can impose a fine of any amount. The High Court is where serious crimes are heard – such as murder and rape. There are no limits on the length of prison sentences in the high court, or on the amount of any fine imposed. The Justice of the Peace Court hears only minor summary cases. The maximum sentence is sixty days in prison or and fines go up to £2500. The vast majority of cases in Scotland are heard in summary procedure.

The Procurator Fiscal will usually decide whether your case should go to court and which court your case should be heard in. Usually, Sheriff Court or Justice of the Peace Court cases are held in the court closest to where the crime was committed. High Court cases are heard in the High Court in Edinburgh, Glasgow or Aberdeen, and in some cases the High Court may also sit in a town or city near where the crime happened.
