Debt Recovery Process

Acting on your behalf, our lawyers will follow a process for collecting debts owed. First of all, we will send a letter of demand notifying the debtor of the outstanding amount, and informing them that action will be taken if they do not pay. If this is not successful, we will discuss our options with you and with your permission will commence legal proceedings. We will take steps to enforce the debt if liability is admitted. If the claim is disputed, we will proceed to litigation. It is also possible to recover interest on outstanding debts, starting thirty days after the debt was due. We will always take steps to recover interest for our clients.

Court Action for Debt Recovery

There are three types of action for debt recovery in Scotland’s courts. A small claims procedure is for debts up to £3000 and is the simplest and least expensive form of action available. Summary cause procedure is used for debts between £3,001 and £5000. Ordinary procedure is for sums exceeding £5000. Ordinary cause procedure is a far more complex process and more costly than summary cause procedure. Most straightforward debt recovery actions are heard in the Sheriff Court either in the district of the defender’s trade or where the defender lives.
